  4. Public Auction: If the borrower cannot resolve the default, the property will be sold at a public auction. The highest bidder will take ownership of the property.
  5. Post-Foreclosure: If the property does not sell at auction, it becomes Real Estate Owned (REO) by the lender. The lender will then attempt to sell the property directly.

 

Recourse vs. Non-Recourse in Nevada


Nevada is generally considered a non-recourse state for residential mortgages, especially for loans obtained on or after October 1, 2009. This means that if a foreclosure sale doesn't cover the full amount owed on the mortgage, lenders typically cannot pursue the homeowner for the remaining balance, known as a deficiency. However, there are exceptions, and the specifics can vary based on individual circumstances.
